1. Introduction
The KoR SRQ ("The KoR," "we," "us," or "our") operates the website located at https://thekorsrq.com (the "Site") and provides private gym, cold plunge, sauna, and recovery services, including HYROX training, race preparation, and our Injury Recovery Training Program, to members and guests in Sarasota, Florida. We respect your privacy and are committed to protecting the personal information you share with us.
This Privacy Policy describes the types of information we collect through the Site and our related services, how we use and share that information, and the choices and rights available to you. By accessing or using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Site.
2. Information We Collect
We collect information in three ways: information you provide directly to us, information we collect automatically when you use the Site, and information related to your membership or account.
Information You Provide to Us
When you submit a form on our Site — such as our inquiry forms (Schedule a Tour, Apply for Membership, Book Recovery, Injury Recovery Training, Combatives Inquiry, and Venue Inquiry) — or otherwise contact us, you may provide:
- Your name;
- Your email address;
- Your phone number;
- Your fitness, training, and wellness goals;
- Your preferred days and times for visits, sessions, or appointments; and
- Any other information you choose to include in a message or inquiry.
Information Collected Automatically
When you visit the Site, we and our service providers may automatically collect certain technical information, including:
- Your Internet Protocol (IP) address;
- Device type, operating system, and browser type;
- Referring and exit pages, pages viewed, and the dates and times of your visits;
- General location inferred from your IP address; and
- Information collected through cookies and similar technologies (see Section 5).
Membership and Account Information
If you become a member or book services, additional information is collected and maintained through our membership and booking platform, GymMaster. This may include your account credentials, membership tier and status, billing and payment information processed by GymMaster or its payment processors, check-in and access records, and booking history. We do not store full payment card numbers on our own servers.
3. How We Use Information
We use the information we collect for the following purposes:
- To respond to your inquiries, tour requests, and other communications;
- To provide, operate, and administer our memberships and services;
- To process and manage recovery sessions, class reservations, and other bookings;
- To send you transactional messages such as confirmations, reminders, and account notices;
- To send marketing and promotional emails about The KoR, where permitted (you may unsubscribe at any time);
- To understand how visitors use the Site and to improve our content, offerings, and user experience through analytics;
- To maintain the security and integrity of the Site and our facilities;
- To comply with our legal obligations, enforce our agreements, and protect our rights and the rights, safety, and property of our members, guests, and staff.
4. Text Messaging (SMS)
We collect your mobile phone number when you submit it through one of our forms. If you also check the SMS consent box on that form, you provide your express written consent to receive recurring text messages from The KoR at the number you provided — including scheduling messages, appointment and class reminders, confirmations, and account or service updates. Checking the box is optional, and providing this consent is not a condition of purchasing any goods or services from us.
Message frequency varies. Message and data rates may apply. You can opt out of text messages at any time by replying STOP to any message; reply HELP for help. Opting out of texts will not affect any non-SMS communications or your membership.
5. Cookies & Tracking Technologies
We use cookies and similar tracking technologies to operate the Site, remember your preferences, and analyze traffic. Cookies are small text files placed on your device. We use both session cookies (which expire when you close your browser) and persistent cookies (which remain until they expire or are deleted).
We use Google Analytics to help us understand how visitors interact with the Site. Google Analytics uses cookies to collect information such as how often users visit, what pages they view, and what other sites they used prior to arriving. We use this information to improve the Site. Google's ability to use and share information collected by Google Analytics is governed by the Google Analytics Terms of Service and Google's Privacy Policy.
We also use Constant Contact website tracking, from the same provider that sends our email. This one works differently from the analytics described above, so we want to be plain about it: rather than counting visits anonymously, it can associate the pages you view on the Site with your record as one of our email contacts — most commonly when you arrive by following a link in an email we sent you. We use it to understand which parts of the club you are interested in and to make what we send you more relevant, rather than emailing everyone the same thing. We do not use it to build profiles for sale or transfer, and we never sell your information. Constant Contact's handling of the information it collects is governed by its own privacy notice.
We also use advertising tools from Google and Meta (Facebook and Instagram) to understand which advertisements bring people to the Site and to show our advertisements to people who have visited it. The Meta Pixel runs on the pages of this Site, with one deliberate exception: it does not run on our Injury Recovery Training page or its application form, and we never send Meta anything about an Injury Recovery Training application. Google's analytics and advertising tags do not run there either. It places a cookie in your browser and tells Meta the address of each page you view, so this happens as you browse, not only when you contact us. When you submit one of our forms, we additionally send Google and Meta a record of that submission and which form it was. Your email address and phone number are irreversibly hashed before they are transmitted — we do not send your contact details to these platforms in a readable form, and we never sell your information. Meta uses what it receives for its own purposes as well as ours, as described in its own terms.
You can control cookies through your browser settings, including blocking or deleting cookies. You may also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on. Blocking or clearing cookies also stops Constant Contact website tracking from associating your browsing with your contact record, and unsubscribing from our email removes the link most commonly used to make that association. You can manage how Meta uses your information for advertising through your Facebook ad preferences, and opt out of interest-based advertising from participating companies at the Digital Advertising Alliance. Please note that disabling cookies may affect the functionality of certain features of the Site.
6. How We Share Information
We do not sell your personal information. We share information only as described below.
Service Providers
We share information with trusted third-party service providers who perform services on our behalf and are authorized to use your information only as necessary to provide those services. These include:
- GymMaster — our membership management, booking, and access-control platform;
- Constant Contact — our email marketing platform, which also provides website tracking that can link your activity on the Site to your contact record;
- Resend — our transactional email delivery provider;
- Twilio — our SMS/text-message delivery provider;
- Google Analytics — our website analytics provider;
- Google Ads and Meta (Facebook/Instagram) — our advertising platforms. Through the Meta Pixel these receive the address of each page you view on the Site along with a browser advertising identifier, and, when you submit a form, a record of that submission with any contact identifiers hashed and unreadable. Meta receives nothing from our Injury Recovery Training page or application; and
- Netlify — our website hosting provider.
Legal and Safety
We may disclose information if required to do so by law or in the good-faith belief that such disclosure is necessary to comply with legal process, respond to lawful requests from public authorities, enforce our Terms of Service, protect against fraud, or protect the rights, property, or safety of The KoR, our members, guests, staff, or others.
Business Transfers
If The KoR is involved in a merger, acquisition, financing, reorganization, or sale of all or a portion of its assets, your information may be transferred as part of that transaction, subject to the commitments made in this Privacy Policy.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to provide our services, to comply with our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed, we take reasonable steps to securely delete, anonymize, or de-identify it.
8. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect against unauthorized access, use, alteration, and disclosure. We rely on reputable third-party platforms that maintain their own security measures. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. Your Choices & Rights
You have choices regarding your personal information:
- Access and correction: You may request access to, or correction of, the personal information we hold about you.
- Deletion: You may request that we delete personal information we have collected from you, subject to certain legal exceptions.
- Marketing emails: You may unsubscribe from our marketing emails at any time by clicking the "unsubscribe" link in any such email or by contacting us. You may continue to receive non-promotional, transactional messages related to your account or bookings.
- Text messages: Where we send SMS messages, you may opt out by replying STOP to any message or by contacting us. Message and data rates may apply.
To exercise any of these rights, contact us using the information in Section 15. We may need to verify your identity before fulfilling your request.
10. California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA/CPRA"), provides you with additional rights regarding your personal information, including:
- The right to know what personal information we collect, use, disclose, and share about you;
- The right to delete personal information we have collected from you, subject to certain exceptions;
- The right to correct inaccurate personal information;
- The right to opt out of the sale or sharing of personal information; and
- The right to non-discrimination for exercising your privacy rights.
We do not sell or share personal information as those terms are defined under the CCPA/CPRA. To exercise your California rights, contact us using the information in Section 15. You may designate an authorized agent to make a request on your behalf, subject to verification.
11. Children's Privacy
The Site and our services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under the age of 13 (or under 16 where applicable law requires). If you believe a child has provided us with personal information, please contact us and we will take steps to delete such information.
12. Third-Party Links
The Site may contain links to third-party websites, applications, or services that are not operated or controlled by us. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you access.
13. International Users
The KoR is based in the United States, and the Site is intended for users located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we make changes, we will revise the "Last updated" date at the top of this page. Material changes will be communicated through the Site or other appropriate means. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Privacy Policy.
